Terms and conditions

These terms govern your use of kinectnow.com and its persona subdomains (agency.kinectnow.com, coach.kinectnow.com, consultant.kinectnow.com), together, the site. By visiting the site or joining our waitlist, you agree to these terms. If you do not agree, please do not use the site.

KINECT is currently in a pre-launch, waitlist stage. These terms cover the marketing site and waitlist described here. When our client-portal product launches, it will be governed by its own terms of service, separate from this document.

You agree to use the site only for lawful purposes. You agree not to attempt to gain unauthorized access to the site or its underlying systems, interfere with the site's normal operation, scrape or harvest content at scale without our permission, or use the site to transmit anything unlawful, harmful or fraudulent.

Joining the waitlist lets us notify you when the KINECT product becomes available. Joining the waitlist does not create any obligation on either side: it is not a purchase, a reservation, a contract for future service or a commitment from KINECT to launch by any particular date, in any particular form, or at all.

Pricing shown anywhere on this site reflects our current intent at the time it is displayed. It is not a quote, offer or price lock, and it may change before launch. Final pricing will be confirmed when the product becomes generally available.

The site, including its design, text, graphics, logos and the KINECT name and marks, is owned by KINECT or its licensors and is protected by applicable intellectual property laws. Except for the limited right to view the site for your own personal or business evaluation of KINECT, nothing in these terms grants you any license to copy, modify, distribute, sell or otherwise exploit the site's content without our prior written permission.

The site may reference or link to third-party services. We do not control those services and are not responsible for their content, availability or practices. Your use of any third-party service is governed by that service's own terms.

The site and any information on it are provided on an as-is and as-available basis, without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the site will be uninterrupted, secure or error-free, or that any information on it, including projected features or pricing, will remain accurate until launch.

To the fullest extent permitted by law, KINECT and its officers, employees and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of or related to your use of the site, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or related to the site or these terms will not exceed one hundred US dollars.

We may update these terms from time to time as the site and our plans evolve. We will update the date at the top of this page when we do. Continuing to use the site after an update means you accept the revised terms.

These terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.
